TVW Complains About Constantine's Use of its Footage

Greg Lane, head of the state public-affairs cable station TVW, released a statement today complaining that the Dow Constantine campaign violated the station’s copyright policy by using its footage in an anti-Susan Hutchison commercial. The footage showed Hutchison praising the Washington Policy Center, a conservative think tank, at its annual dinner; the commercial has also sparked claims by the WPC (eviscerated pretty thoroughly by The Seattle Times) that the Constantine camp was misrepresenting their positions on climate change, light rail, class sizes, and green jobs.

In the statement, Lane said:

The citizens of Washington trust TVW to provide unedited and unbiased access to public policy events. Editing and using our programming for political ads both violates that public trust and puts at tremendous risk the public’s access to these events.

Yesterday, I spoke directly to representatives of the Constantine campaign, requesting that the offending ad be pulled from the air immediately. This morning, the campaign’s lawyers responded that the Constantine campaign is refusing to abide by our request. We are disappointed with their response, which completely ignores the public interest and the tradition of respect maintained for TVW’s unique role.

TVW’s copyright policy prohibits “Re-use of any of TVW’s content and graphics online for any commercial or political purpose.” The station raised a similar complaint back in 2006, when the Democratic Congressional Campaign Committee used TVW footage in an ad opposing Congressman Dave Reichert (R-8).

Lane tells PubliCola that in his experience, local and state political campaigns who have used TVW footage in commercials have agreed to pull the ads upon request without exception—until now. As an example, Lane cites a Republican ad against state Sen. Mary Margaret Haugen several years ago.

“This is the first time that a local candidate has decided to go this route,” Lane says. “It just puts at risk the access we have to covering this wide variety of events. That is our biggest concern.”

The Constantine camp says they have no plans to pull the ad, which has been running since earlier this week, from the air. “We have every legal right to use the footage” under fair use, which allows the use of snippets of copyrighted materials in political ads, Constantine spokesman Sandeep Kaushik says.

Lane counters, “They’re hiding behind a fair use legal argument and ignoring the greater public interest. … It harms the public trust and greatly threatens the access we have” to private events like the WPC dinner, he adds.

Kaushik responds, “We appreciate their concerns, but their policy is supposed to be predicated on doing what’s best for the public interest and advancing public dialogue about core issues. The public has an interest in knowing where Susan Hutchison stands on these core issues.”

Meanwhile, unless you happen to catch the ad on TV, you aren’t likely to come across it for a while: Youtube pulled the ad today “due to a copyright claim by Washington Public Affairs Network.”An unedited version of the video is available on TVW’s web site. “What we’re talking about here is a fundraising dinner for a right-wing organization which then posted the entire video on their web site for years, for promotional purposes, without any complaint from TVW.

    Why does TVW get a pass for promoting the Full Gospel Business Men's Fellowship? In TVW's world, it would be illegal to even post their own content pointing this out.

  • TVW is clearly in the wrong here. This is a pretty obvious case of Fair Use, whether TVW likes it or not.

    Why TVW, a publicly-funded organization, hasn't had its hand slapped by the Legislature for its ludicrous "copyright policy" is beyond my understanding. Perhaps it is time to put some pressure on the Legislature to encourage TVW to recognize the legal realities of Fair Use and to draft more reasonable copyright policies.

    Or, heaven forbid, perhaps the footage that is paid for with public money should be released under a Creative Commons license so that the pubic is free to re-use, remix and redistribute the content we've paid for.

    @24: Well... because the dispute is between two parties: TWV and the Constantine campaign. Susan's campaign hasn't weighed in and, to my knowledge, has nothing to do with this debate. I know that you read PubliCola regularly, so you're surely aware of the many times we HAVE talked to Jordan at Hutchison's campaign.

    Greg Lane is a longtime Republican operative, and Rob McKenna's former deputy chief of staff. Prior to that, he was a Republican legislative communications staffer. He's been a past contributor to House Republican Leader Richard DeBolt, under the leadership of whom the House Republicans' PAC sent out phony sex offender notification postcards against House Democrats in 2006. Nice Hail Mary pass on Hutchison's behalf!

    Me and Chaz were having a fun conversation about transportation, but that was eons ago. And there was another one about the definition of living wage, and how to achieve more people having living wages, but that, too, fizzled.

    Well, I was at the Philipino restaurant at Beacon Hill on Sunday when Mallahan and his staff came in and sat down to order food. Guess--what-- McGinn poster was up in his face. He was talking to the people in the reastaurant. One guy said "We allready voted and voted for McGinn.
    Mallahan all this suckers in your campaing staff will eat up you to the end, and i am sure you will report back to your T-Mobile job, soon after the election... Not to the city hall

    Mallahan is using developrs and establishment money to break every possible rules in our land. He is for relaxing guns in our parks and our neighborhoods, he is backing unpopular Tunnel that puts the hard working families on the hook, He has not mention anything meaningful other than claiming "Management Skills" he could not prove. The only he is on the race is not because he has vesion, but he put $200,000 of his money into the campaign. Nov 3rd will be judgment day.     This is ridiculous (the TVW complaint). Campaigns are about ideas and taking positions. If one candidate can't use a public record of another's statements to illutrate differences on the issues, then where have we come to as a democracy?

    I too would love to hear your LawNerd's opinion on this matter. My understanding of the Fair Use Doctrine is that it's pretty clearly legal, and yet his stupid argument comes up every cycle. Besides this, Rossi/BIAW got lots of the WA Dems YouTube ads pulled with copyright claims regarding music and footage. And in 2006, TVW and the DCCC had it out over a similar clip of Dave Reichert.

    Does TVW not understand the law? Do those of us that think it's fair use not understand the law? Just saying -- it's not as if C-Span claims the right to pull down a 3 second clip of John Kerry saying "actually voted for it before I voted against it" from an ad in a high-stakes race like the Presidential. (Or even KOMO or KING for that matter.)

    Just to be clear, YouTube automatically pulls anything once it gets a take down notice. The video uploader then has 14 days to respond with a counter-notice, upon which YouTube has 14 days re-enable the video pending further legal action.

    So YouTube pulling the ad says absolutely nothing about the validity of the claim.

    TVW is a 501 (c)(3) non-profit corporation, not a government agency. It is governed by an independent board of directors. The majority of TVW's operating cash - approximately $2.5 million per year - comes from the Legislature via a contract-for-service through the Secretary of State. TVW receives more than $11 million per year in the form of in-kind contributions of channel space from Washington's cable television industry.

    What proof do you have that Mallahan has violated any copyright laws? Has King 5 stated that he is using the images without permission?

    And did you not notice - the Firefighters had disclosed to the PDC, and made an oversight by not reporting to SEC, as well.

    Mallahan hasn't done anything to indicate that he is "above the law", as you put it.

    I'd love to hear from LawNerd on the topic of the fair use in political free speech. My guess is that courts would construe the fair use doctrine pretty broadly in this construct.

    @3 Viatnamese doesn't seem to understand the fair use or provisions that prevent coordination between candidate campaigns and independent expenditure organizations.

    He sure did. That was KING 5. that is complete violation of copyright. Not to mention 100k violation of firefighter. Mallahan is acting as if he is above the law. That is not mayor we want to lead our law abiding and progressive city

    TVW can claim copyright all it wants. Doesn't change the fact that Dow's got the law behind him. It's called the Fair Use doctrine. TVW should take a look at it and STFU.
